Copying Other People's work.....!!!

This is the kind of thing that makes artists furious. Artists are sensitive people, and we really care & are passionate about what we do! So, when someone comes along & STEALS our designs, we need to take action, and that is what I am doing right now with this post. A tiny company called jack in the box designs, is claiming that the prints they are selling are their designs. Are you kidding me? I recognize a few that I know for a FACT aren't their designs, including mine!  I know I should expect this kind of disrespect, but this is just plain wrong!!  

They aren't just RIPPING me off, but others at the same time! Do they think because they are in Canada it's ok?? Well, they're wrong! Copyright laws exist all over. Here's the even funnier part, they say on their blog they created these designs 3 years ago....but coincidentally, all their designs are using my exact color schemes as well as ones from Binth, Penny People and Chaiv.  They also had the nerve to go to some kind of show & exhibit their work (you know, the designs they're ripping off). I don't mind if someone makes a replica for their own personal use, but for commercial purposes....that, I am not cool with. 

Please help support the artists and businesses who work their butts off to create and come up with original work. Tell people like this that they are WRONG and they are clearly copying others. How do they justify this behavior??!?  How do you feel about this?  What if it was your work?

Something as simple as "you are clearly copying other artists work".

**UPDATE**: These copycats have now deleted their Facebook page & their blog, however, neither I nor the other artists/designers have gotten a response from them. Figures. If they appear again, I'm certain my readers and customers will tell me.

  4. as a Graphic Designer, I would be more then just furious if someone copy my work, claiming it as theirs and trying to make money out of it. You should definitely take some action! I dont mind if others are using other people's graphic as an inspirations..but not copying the whole thing!

  8. I'd be pissed! I had others copying website designs (and code) of mine and was furious! I contacted them and requested to take it down otherwise I would go to a lawyer and sue them. Luckily it worked and they took it down because truth was that my chances (I am from Germany, the other person/company was from Turkey) to procced anything against them were pretty low... So it really depends but if there were any chances to sue them successfully I'd do so. I'm really tired of people ignoring copyrights ...

    I can't believe they are claiming that the designs are theirs and even tell some stories how they came up with them! What's wrong with people????

  9. Oh, Jen, I hate this. How awful. I don't understand how companies can do that and think that it's ok. I will never understand why people want to be copy cats! Be who you are and express YOUR ideas! Not someone else's! I support you and other artists one hundred percent :)

  38. K.E.R: She is reading our emails but not one PEEP out of her. No email yet...oh yes, she also deleted the posts. What she isn't aware of is that one of the designers lives in Canada, not too far from that shop. I already spoke to the artist and she is ready to defend her design and work.

  44. gotta hate that. don't they know that it's copyright infringement? well, i guess this post worked because when i clicked through to their blog, there wasn't anything there. no posts at least. and only 3 followers.

    so glad you found them though. i have found a site that copied my post and pictures word for word without permission. so sad that people can't come up with their own original content or work and have to copy others to try to make money.

  49. That just plain sucks. I had a similar situation, and ended up taking action by trademarking my design. It worked out well, because the attorney let me pay her in product!

OLEANDER: I'm another one of the designers whose work was copied (chaiv) and I am also originally from Canada--I think what Jen meant when she mentioned the copycat being Canadian was that they were trying to tap into another market outside of the US and thought they would slip under the radar if they did this--I thought the same thing when I noticed they were selling in Canada. No offense intended and certainly none taken on my end Jen! Thanks for posting this on behalf of all of us! I hope they've learned their lesson.

  65. You know they think they are very clever...but look at the copies compared with the originals. The copies lack so much....yes...colors are the same...but they don't have the feeling for correct leading or letter spacing. Oh they think they have copied you exactly...but you can see in their work...they lack true talent...even when copying.
    As a fellow designer and artist...I feel your pain...of course I looked at them and thought....they can't even copy correctly! What no talent losers.

  74. Awful awful awful!!!! It infuriates me knowing this. It's happened to me in the past and i was so angry! I contacted an Anti-Copyright company for help and support. Thankfully it got dealt with, however how am i ever to know it won't, or hasn't happened again!? I hope you get this resolved quickly. It just goes to show that unfortunately some designers haven't enough talent or passion to make their own mark!

    As a designer myself I feel nervous about showing my work on the internet, but I guess just as long as everyone works together to keep a look out for copycats then hopefully they can be stopped :)

  81. Wow, thanks for posting this! I had initially brought attention of the copycat to Chaiv and as a result of the blogosphere helping artists/designers out, they have shut them down (online at least)!

    I get annoyed by these situations as well and in this case, it was a really blatant case of plagiarizing but I am actually even more frustrated by designers whose portfolio of work are all "inspired" by other print designers. (Actually you have one such seller in your "must visit" sidebar feature - such irony.) Although I LOVE selling on Etsy, I find that it is now such an easy source of such plagiarism from other sellers. But it's challenged me to be even more unique, to create new designs more frequently.

    This is more popular than people know. I know people copy shit (yes sucks to say but its a form a flattery) but if you do it for your own personal reasons it's one thing, but to go ahead and sell it claiming it's your own... COME ON!!! You should go to hell for that. (Sorry I'm a little dramatic) I hate people who do that, and good for you for posting about it. (Which lead to taking down their blog and FB page)

    I realize this similar situation has happened to many artists ....so it's not that uncommon. Sorry it also happened to you too. I understand why you were angry, that's how i felt...and we don;t know if it will happen again, but I'm sure I will find out if it does. People always email me and are nice enough to report things like this....

    So far they pulled their FB page and their blog...if I find out they are on Etsy or anywhere else, I will keep going after it with support from lots of people. Thanks!

  106. I have had this same problem myself and it still infuriates me. WHY do people do this ?? HOW can it feel rewarding if it's not their own gift they are using ? I believe there is room for everyone to be successful in this world, no need to ride any coattails.

  109. I don't stand for any kind of copyright infringement, and I see what you're saying on almost all of these but can you copyright the alphabet/kids name thing? My grandma cross stitched me one of those and I was born in the 80s, long before you put those out. That's the only piece I wonder about... I promise I'm not saying you took the idea or something but on certain things that are so generic I wonder. They did take the idea from you (as proven by a billion other pieces exactly like yours that you showed they ripped off) so I'm not disputing that. Sorry that this happened to you!

  112. Hi, I've only newly gotten to visit your blog a few short times recently, but this was just awfully tragic! I'm so sorry to hear it. (Yours, and the other artist's originals really are beautiful, btw)!

    I noticed that they didn't take the very exact originals to show and sell, they just obviously took the idea, colors, and layouts...which I fully agree is just as much the travesty. Though I was curious, in your looking into this, have you found what the laws do say about how similar something has to be to be copyright infringement? I'd always heard rumors that as long as 10% of something like logos, etc. were different, that they were legal. And then I saw a school change exactly 11 features of another sport team logo to stay legal recently. So I wondered if you were at all concerned that these people might not get their just punishment, since they tried to tweak a couple things? (Like, I thought it was funny to immediately notice the glaringly obvious and oft-overused Gill Sans as their copy-cat typeface of choice (with their bad leading and kerning), instead of the more creative and finely letterspaced one you used. :)

    Anyway, I hope you and the others are able to come out with a happy ending in all this, and the thieves their due justice as well.

  114. Hi Jen, I've been following your blog for a while now and this is the lowest thing an "artist" can do. I've already sent them an email though I doubt they'll respond. If you want to take action talk to a lawyer that knows about copyright, unfortunately these laws don't really help too much and there are geographical limitations, so the fact that she's in canada actually could help her, as infuriating as that is, but I'm no lawyer and there's a lot more to this type of law that meets the eye.

    Still, they must have gotten a pretty strong response from people to disappear like that. nice.

  115. Actually, I would say that the images she's created are downright identical to the originals. And she's copied my work, and I'm in Canada, so I don't think she did this because of "geographical" reasons, but instead just because of the pure reason that she thought she could profit off of other peoples designs.

    I agree with you both of you 100%....
    This person was obviously aware she was infringing upon someone else's work. I know there are a bunch of legalities involved but it doesn't make it right. I will do whatever I can to make it known (if she appears again) that she is doing this intentionally knowing that the work is clearly not her idea. She knows she was STEALING ideas...I mean they are almost identical. She even placed the same colors in the same spots. The only thing she didnt do is the same font in some, perhaps because she couldnt find it. She is clearly aware of what she was doing and that is the reason for her LACK of response to my emails & the emails from the other artists...as well as readers.
